Malema takes a swipe at Musk, Trump after ‘Kill the Boer’ court victory

Economic Freedom Fighters (EFF) leader Julius Malema has taken a swipe at United States President Donald Trump and his ally Elon Musk following a court victory over the ‘Kill the Boer’ chant.

On Thursday, 27 March, the Constitutional Court dismissed lobby group AfriForum’s bid to appeal the Supreme Court of Appeal’s ruling that the ‘Kill the Boer’ chant is not hate speech.

JULIUS MALEMA CELEBRATES COURT RULING ON ‘KILL THE BOER’

The highest court in South Africa said it has considered the application for leave to appeal and has concluded that the application should be dismissed as it bears no reasonable prospects of success.

As previously reported, In 2022, the Equality Court sitting at the Gauteng High Court in Johannesburg ruled against AfriForum which sought to categorise the song as hate speech that incites violence.

The court said AfriForum failed to show that the lyrics of the song contravene the Equality Act or demonstrate a clear intention to harm or incitement. It further ruled that declaring the ‘Kill the Boer’ song as hate speech, would curtail freedom of expression. The lobby group has since approached the Supreme Court of Appeal and recently the Constitutional Court which has also ruled in favour of the EFF.

Following the court ruling Malema took to X to celebrate and tagged Donald Trump and Elon Musk who have accused him of inciting violence by singing ‘Kill the Boer’.

“The ⁦@EFFSouthAfrica⁩ superior logic prevails again. I want all of you combined with your white supremacist; we will still show you flames. Try me boys. ⁦@elonmusk⁩ ⁦@realDonaldTrump,” he posted.

Recently, Malema faced harsh criticism from Americans including Secretary of State Marco Rubio for singing the chant. Rubio said ‘Kill the Boer’ is a chant that incites violence.

“South Africa’s leaders and politicians must take action to protect Afrikaner and other disfavored minorities. The United States is proud to offer those individuals who qualify for admission to our nation amid this continued horrible threat of violence,” Rubio posted on X after a video of Malema singing the chant during a Human Rights Day event on 21 March was circulated on social media.

‘AN INTERNATIONAL CRIMINAL’

In February, Musk called for Malema to be declared an international criminal and also took to X to question why President Cyril Ramaphosa had not taken action against Malema “for calling for the genocide of white people”.

In another post, Musk called for sanctions against Malema and for the firebrand politician to be declared an international criminal.

The call happened just days after US President Donald Trump, who is advised by Musk, cut aid funding to South Africa on assertions that the country was “confiscating” land via the Expropriation Act.

The newly signed act says the government may, in certain circumstances, offer “nil compensation” for property it deems necessary to seize in the public interest, but only after attempts to reach an agreement on compensation with the owner.

In response, the EFF told Musk and all of his “allies, in the US, in Israel and the right-wing groups in South Africa which have mobilised Musk, to go to hell”.
