Hawks ask NDPP to review decision to withdraw Kodwa’s corruption charges

The National Director of Public Prosecutions (NDPP) advocate Shamila Batohi is set to review the decision to withdraw the corruption charges against former sport, arts, and culture minister Zizi Kodwa.

The National Prosecuting Authority confirmed that the office of the NDPP received a letter from the Directorate for Priority Crimes Investigation (also known as the Hawks)  requesting Batohi to review the decision of the Director of Public Prosecutions (DPP) South Gauteng, advocate Andrew Chauke to withdraw Kodwa’s corruption charges. 

NDPP TO REVIEW DECISION TO WITHDRAW ZIZI KODWA’S CORRUPTION CHARGES  

On Friday, 1 November, Chauke withdrew the charges of Corruption in Contravention of the Prevention and Combating of Corrupt Activities Act (PRECCA) against Kodwa and his co-accused businessman Jehan Mackay.

Chauke withdrew the charges against former Minister Zizi Kodwa and his co-accused after receiving representations submitted on behalf of the accused.

As previously reported, in June, Kodwa and Mackay were charged with corruption as the former minister and member of Parliament allegedly received R1.6 million in kickbacks from Enterprise Outsourcing Holdings (EOH) as the IT and software company scored tenders from various government departments.

NPA spokesperson Mthunzi Mhaga said in terms of Section 179 (5) (d) of the Constitution, the NDPP may review a decision to prosecute or not to prosecute after consultation with the relevant DPP and after taking representations within a specified period from the accused person; the complainant; any other person or party 
whom the NDPP considers to be relevant.

“The NDPP will review the decision in line with the above-stated legal framework and communicate the decision accordingly,” Mhaga said.
