News that Rachel Kolisi is taking the Kolisi Foundation – co-founded with her former partner Springbok captain Siya Kolisi – to the CCMA has had a strong reaction among South Africans.
Rachel stepped down from her role as CEO last month, less than six months after the former couple’s divorce announcement. The philanthropist claims the foundation made her position “intolerable,” forcing her to leave.
But while some believe the mother-of-two is entitled to compensation and even reinstatement, others claim the move is “messy” and “unnecessary.”
FANS TAKE SIDES OVER SIYA, RACHEL KOLISI FOUNDATION DRAMA
This week, Rachel Kolisi filed papers with the CCMA, challenging the Kolisi Foundation board over allegations that it made her position as CEO “intolerable.”
The papers claim that Rachel “resigned because the employer acted unfairly and made continued employment intolerable.”
She is seeking “reinstatement and/or compensation.”
Neither Siya nor Rachel has commented on the news, and the Kolisi Foundation has yet to make an official statement.
South Africans, however, have weighed into the “messy” situation. On social media, fans of the former couple have even taken sides between Siya and Rachel Kolisi.

DID SHE RESIGN, OR WAS SHE DISMISSED?
Last month, the public learned that Rachel Kolisi had stepped down from her leadership role at the Kolisi Foundation.
Although the foundation did not officially announce the news, it was revealed through another foundation, the anti-gender-based violence NGO, The Justice Desk.
So, how is Rachel claiming that she was unfairly dismissed?
According to the CCMA, a “constructive dismissal” occurs when an employee is “forced to resign,” effectively constituting an “unfair dismissal.”
The Labour Guide states that in order to show that constructive dismissal has taken place, the former employee must prove the following…
- Employment circumstances were so intolerable that the employee (Rachel Kolisi) could not continue to stay on.
- Unbearable circumstances were the cause of the resignation of the employee.
- There is no reasonable alternative but for the employee to resign to escape the circumstances.
- An unbearable situation must have been caused by the employer (Kolisi Foundation)
- The employer must have been in control of the unbearable circumstances.
