Former President Jacob Zuma is expected to return to court on Monday to challenge the Pietermaritzburg High Court’s decision to dismiss his private prosecution of state counsel Billy Downer and journalist Karyn Maughan as immediately enforceable.
The Jacob Zuma Foundation spokesperson, Mzwanele Manyi, said Zuma will attend court proceedings.

In August, the court rejected to suspend its 7 June judgement, which found the former president’s private prosecution illegal, and adjourned the case awaiting the outcome of the former president’s motion for leave to appeal.
Downer and Maughan filed an enforcement appeal, asking the high court to obtain an injunction banning Zuma from pursuing private prosecution against them while the case was being appealed.
But, the former president filed an appeal against the enforcement order.
Zuma requested that the enforcement order be dismissed, claiming that the urgency of the enforcement action was fabricated and amounted to an abuse of court processes.
According to the former president’s lawyer, no special circumstances for the order were proved on a balance of probability, and the underlying judgement for the order was “inherently deficient and riddled with irregularities.”
Zuma and the French arms company Thales are accused of fraud, racketeering, and money laundering in connection with a multibillion-rand arms contract in 1999.

Meanwhile, the Johannesburg High Court delayed its decision last month on Zuma’s bid for leave to appeal a verdict that dismissed his private prosecution of President Cyril Ramaphosa.
This comes after the court dismissed Zuma’s private prosecution of Ramaphosa in July, calling the application illegitimate and unconstitutional.
